The instant application has been filed for condonation of delay of 217 days in filing the appeal under Section 37 of the Arbitration and Conciliation Act against the judgment dated 01.07.2024 passed by the learned District Judge, Mandi in Arbitration Petition No. 77 of 2023. It is averred in the application that the applicant had engaged M/s M.V. Kini & Co. as its counsel in number of cases including the case in hand. The said counsel proved to be inefÏcient, which resulted in delay in getting correct information about the fate of the cases. The applicant then changed its counsel and thereafter the matters were processed and the instant appeal has been filed without any unnecessary and further delay. Reply has been filed. However, there is nothing in the reply to discredit the claim made in the application. The application is duly supported by the afÏdavit of competent ofÏcer. There is nothing on record to disbelieve the averments made therein. Accordingly, the application is allowed and the delay of 217 days’ in filing the appeal is condoned.
