This criminal miscellaneous petition has been filed at the instance of the petitioner for restoration of CrMP no. 322 of 2023 to its original file. Learned counsel for the petitioner submits that the CrMP no. 322 of 2023 was dismissed vide order dated 10.05.2023 for default of the petitioner. Learned counsel for the petitioner submits that since the case could not be marked due to inadvertence, the conducting counsel for the petitioner could not come to court when the case was called out, which resulted in dismissal of CrMP no. 322 of 2023. It is further submitted that the petitioner has very good grounds to agitate in this case and unless the same is restored to its original file, the petitioner will be highly prejudiced. Hence, it is submitted that CrMP no. 322 of 2023 be restored to its original file. Learned counsel for the State has no serious objection for the prayer for restoration. Considering the aforesaid submission of the learned counsel for the petitioner, CrMP no. 322 of 2023 is restored to its original file to the stage, at which, it was before its dismissal.
