[2025:RJ-JP:27819] HIGH COURT OF JUDICATURE FOR RAJASTHAN BENCH AT JAIPUR S.B. Civil Writ Petition No. 6896/2025 Rajendra Yadav S/o Kamal Yadav, R/o Plot No. 30, Vikas Nagar, Jaipur, Presently R/o 62, Vikas Nagar, Jaipur. ----Petitioner-Applicant Versus Laxminarayan Jat S/o Shri Narayan Jat, R/o Village Hasampurawas, Tehsil Sanganer, District Jaipur, Presently Tenant Plot No. 30, Vikas Nagar, Jaipur. ----Respondent-Non-Applicant For Petitioner(s) : Mr. Tanay Jain, Adv. HON'BLE MR. JUSTICE ANIL KUMAR UPMAN Order 21/07/2025 Learned counsel for the petitioner does not press this petition. Alternatively, counsel submits that he would be satisfied if trial court is directed to conclude the proceedings at the earliest. He submits that an application under Section 9 of Rajasthan Rent Control Act, 2001 (hereinafter referred to as “the Act of 2001” for brevity) has been filed in October, 2015. Counsel submits that about nine years and nine months have already passed. Presently, case is pending for recording evidence of the petitioner-applicant. He further submits that notice of application under Section 9 of the Act of 2001 has already been served upon the respondent and he is not cross-examining the petitioner for one and another reason. Relying upon the provisions of sub-section 5 of Section 15 of the Act of 2001, counsel submits that proceedings under Section 9 of the Act of 2001, pending before the learned Tribunal [2025:RJ-JP:27819] (2 of 2) [CW-6896/2025] should be culminated within a period of 240 days from the date of service of notice on the tenant. Considering the provisions made under sub-section 5 of Section 15 of the Act of 2001 as also looking to the fact that litigation is pending from a long period of time i.e., about nine years and nine months, learned Tribunal is directed to conclude the proceedings on or before 31.03.2026, if there is no legal impediment in continuation of the proceedings, from the date of receipt of certified copy of this order. Petitioner is directed to submit certified copy of this order before learned Tribunal within a period of three weeks from today. With the aforesaid directions, this petition stands disposed of.
