Dev, District Aurangabad, Bihar, earlier residing at Shastri Chowk, D.A.V. Public School, Lohardaga, P.O. + P.S. + Dist.- Lohardaga, Jharkhand. … Opposite Parties ------ CORAM: HON’BLE MR. JUSTICE ANIL KUMAR CHOUDHARY ------ For the Petitioner : Mr. Janak Kr. Mishra, Advocate Mr. Deepak Kr. Sinha, Advocate For the State : Ms. Anuradha Sahay, Addl.P.P. ------ Order No:-03 Dated:-19-12-2025 Heard the parties. This criminal miscellaneous petition has been filed by the petitioner with the prayer for modification of the order dated 07.02.2019 passed in A.B.A. No.4952 of 2018. This is the second journey of the petitioner with the similar prayer as the similar prayer of the petitioner has been rejected by this Court vide order dated 02.08.2019 passed in Cr.M.P. No.654 of 2019. It is submitted by the learned counsel for the petitioner that this criminal miscellaneous petition has been filed by the petitioner with the prayer for modification of the order dated 07.02.2019 passed in A.B.A. No.4952 of 2018 by deleting the condition of depositing the ad interim victim compensation amount. Perusal of the record reveals that earlier vide order dated 02.08.2019 passed in Cr.M.P. No.654 of 2019, this Court rejected the prayer of the petitioner to modify the said order dated 07.02.2019 passed in A.B.A. No.4952 of 2018 by reducing the ad interim victim compensation amount to Rs.1,00,000/-. After about six years thereafter, instead of the petitioner appearing before the trial court, the petitioner has again come up with the prayer to delete the entire amount of ad interim victim compensation. Since, the prayer to reduce the amount of ad interim victim compensation from Rs.2,50,000/- to Rs.1,00,000/- has already been rejected, hence, the prayer to delete the condition of payment of ad interim victim compensation entirely, is also rejected for the same reasons as mentioned in the detailed order dated 02.08.2019 passed in Cr.M.P. No.654 of 2019 by this Court. Accordingly, this criminal miscellaneous petition is rejected. (Anil Kumar Choudhary, J.) Dated- 19.12.2025-Animesh/
