2. PUBLIC PROSECUTOR The Court made the following:
ORDER: Sri M.Eswar, learned counsel, representing Sri Kirthi Teja Kondaveeti,
learned counsel for petitioner, submits that the matter has become infructuous inasmuch as the sole accused/respondent No.2 died long back.
2. The revision was filed challenging the return endorsement dated 17.03.2009 made by the Sessions Judge, Krishna, saying that how the application of the petitioner/defacto complainant could be entertained after passing of committal order and after assigning Sessions Case No.319 of 2008 duly taking cognizance of the offence under Section 354 of I.P.C., basing on the contents of charge sheet.
3. Mr.K.Sandeep, learned Assistant Public Prosecutor has submitted a letter addressed by the Sub Divisional Police Officer, Avanigadda to the learned Public Prosecutor vide C.No.114/SDPO-A/2017, dated 18.04.2017 stating that the accused therein is died of poison consumption. Similarly, in the
order dated 07.09.2017 in S.C.No.319 of 2008 passed by the learned Assistant Sessions Judge, Avanigadda, it was referred that the sole accused died on 01.10.2013.
4. The copy of the death certificate being attested by Sub Inspector of Police, Koduru Police Station showing that the second respondent Thota Yedukondalu died on 01.10.2013. In view of the above, the Criminal Revision Case is dismissed as abated. No order as to costs.
