1. This is second bail application seeking grant of bail to the Applicant who is in jail since 05.11.2024 in connection with Crime No.453/2024 registered at Police Station Nawagarh, Distt. Janjgir Champa for the offence punishable under Section 103(1) of Bhartiya Nyaya Sanhita,
2023.
2. The first bail application of the applicant was dismissed on merit on 29.04.2025 in MCrC No.2884 of 2025.

Learned Counsel for the applicant would submit that the applicant is in jail since 05.11.2024. After withdrawal of first bail application 10 witnesses have been examined out of which PW-10, Chandrakant Kashyap, Constable, is the witness of memorandum and seizure who have not specifically stated anything against the applicant and have not
2 supported the case of prosecution completely. Out of 17 cited witnesses only 10 witnesses have been examined and there is considerable delay in conclusion of trial and therefore the applicant may be enlarged on bail.
4. On the other hand the counsel for the State opposes the bail application and would submit that PW-10 have duly supported the prosecution’s case. Even otherwise the trial is at advance stage and out of 17 cited witnesses 10 witnesses have already been examined and therefore the applicant is not entitled for bail at this advance stage.

Considering the submissions made by the counsel for the parties, considering that no liberty was granted when the first bail application was dismissed and also considering the fact that trial of the case is in advance stage and 10 witnesses have already been examined out of 17 cited witnesses, I do not find any good ground to admit the second bail application and to release the applicant on bail.
