[2025:RJ-JP:41703] HIGH COURT OF JUDICATURE FOR RAJASTHAN BENCH AT JAIPUR S.B. Criminal Miscellaneous Bail Application No. 12374/2025 Shailendra @ Goldi S/o Brahmpraksh, Aged About 34 Years, R/o Village Gasheda, Police Station Buhana, District- Jhunjhunu, Rajasthan. (At Present Lodge At Sub Jail Khetri, District Jhunjhunu (Raj) ----Accused-Petitioner Versus State Of Rajasthan, through P.P. ----Respondent For Petitioner(s) : Mr. Sudhir Yadav For Respondent(s) For Complainant(s) : Mr. Naresh Kumar Gupta, P.P. Mr. Sanjay Khedar HON'BLE MR. JUSTICE MAHENDAR KUMAR GOYAL Judgment / Order 13/10/2025 The present bail application has been filed under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (for brevity “the BNSS”). The petitioner has been arrested in connection with FIR No.0135/2025 registered at Police Station Buhana, District Jhunjhunu for the offence(s) under Section(s) 189(2), 333, 115(2), 109(1), 307 & 324(4) of the Bharatiya Nyaya Sanhita, 2023 (for short “the BNS”) and later on for the offences under Sections 191(2), 190, 115(2), 117(1), 333, 324(4) & 119(1) of the BNS. It is contended by learned counsel for the petitioner that he has falsely been implicated in this case wherein, except a grievous injury on the elbow of the injured-Dharmendra Nehra, he has received no other grievous injury. He submitted that the FIR [2025:RJ-JP:41703] (2 of 3) [CRLMB-12374/2025] contains omnibus allegations against a large number of persons. Qua his criminal antecedents, learned counsel submitted that he has already been acquitted therein by the Court of learned Additional Sessions Judge No.2, Tijara, District Alwar vide judgment dated 29.06.2024. Learned counsel further submitted that similarly situated co-accused namely Amit S/o Suresh Kumar has already been extended benefit of bail by a coordinate Bench of this Court vide order dated 19.09.2025. He, therefore, prayed for release of the petitioner on bail. Although, learned Public Prosecutor assisted by the learned counsel for the complainant opposed the prayer but, could not dispute that the case of the petitioner is not distinguishable from the case of the co-accused Amit who has already been extended benefit of bail by this Court. Heard. Considered. Taking into consideration the contentions advanced by learned counsels for the respective parties and the material on record especially, release of the co-accused Amit on bail by this Court; but, without expressing any opinion on the merits of the case, this Court deems it just and proper to enlarge the petitioner on bail. Accordingly, the bail application is allowed and it is directed that accused-petitioner Shailendra @ Goldi S/o Brahmpraksh shall be released on bail under Section 483 BNSS in connection with afore-mentioned FIR registered at concerned Police Station, provided he furnishes a personal bond in the sum of ₹1,00,000/- (Rupees One Lac only) together with two sureties in the sum of [2025:RJ-JP:41703] (3 of 3) [CRLMB-12374/2025] ₹50,000/- (Rupees Fifty Thousand only) each to the satisfaction of the trial court with the stipulation that he shall comply with all the conditions laid down under Section 480(3) BNSS.
