Petitioner has been made an accused in connection with Hariharganj P.S. Case No. 136/2024, for the offences under sections 103(1), 3(5) of BNS, pending in the Court of learned. A.C.J.M, Palamu at Daltonganj. The petitioner happens to be the husband of the deceased Minki Kumari, who died due to asphyxia because of hanging in her matrimonial home within six months of her marriage. It is alleged that the accused persons including the petitioner used to torture her to enforce the demand of dowry. Learned lawyer for the petitioner submitted that the deceased had left behind a suicide note stating that nobody was to be blamed for her suicide. Regard being had to the facts and circumstance of the case and considering the fact that the deceased had died within six months of her marriage due to hanging in her matrimonial home and there was also allegation that she was tortured to enforce the demand of dowry; I am not inclined to enlarge the petitioner on bail.
