They presented O.S.SR.No.174 of 2015 on the file of the District Munsif at Krishnagiri. In addition, the learned District Munsif also held that the plaintiffs have not prayed for relief against each defendants separately, and paid separate Court fee for each. Challenging the same, this revision. 3.When the matter was called, the learned counsel for the petitioners was absent. 16/20 https://www.mhc.tn.gov.in/judis CRP No. 3386 of 2016 4.The respondents though served have not entered appearance. 5.Under Order VII Rule 11 of the Code of Civil Procedure, a plaint cannot be rejected straight away for non-payment of Court fees. The provision demands that the Court should first come to a conclusion that the suit has been undervalued, and opportunity must be granted to the plaintiff to make good the difference, and even then, if the plaintiff does not pay the permitted Court fee, the plaint can be rejected. 6.Furthermore, this Court in Selvaraj Vs. Koodankulam Nuclear Power Plant India Limited in C.R.P.(MD).No.915 etc., batch of 2020 dated 16.07.2021, has held that it is not the duty of the Court to don the duties and roles of the defendants and raise the defences which should appropriately be raised by the parties. The Court should not play the role of any party, either plaintiff or defendant, but only acts as an impartial adjudicatory authority. Court fee is an issue which has to be raised by the defendants in the written statement or they file an application under Section 12(3) of the Tamil Nadu Court Fee and 17/20 https://www.mhc.tn.gov.in/judis CRP No. 3386 of 2016 Suits Valuation Act, 1965 and raise that issue. Let not the Court take out the role of defendants and enter the game of litigation between the plaintiffs and defendants. 7.In the light of the above discussion, this Civil Revision Petition is allowed. The order passed by the learned District Munsif at Krishnagiri, in O.S.SR.No.174 of 2015 on 23.02.2016 is set aside. The learned District Munsif at Krishnagiri shall number the plaint, if the suit is otherwise in order. For the mere fact that the revision is allowed does not mean that the defendants are barred from raising any plea relating to Court fee.
