JUSTICE M.NAGAPRASANNA) 1. The petitioner is before this Court seeking the following prayer. a) ISSUE a Writ of Mandamus or similar Writ or Direction to the Respondents No.1 to 3 to consider the Representations dated 28.02.2017 and 10.03.2017 sent by the Petitioner Vide ANNEXURES-‘C’ AND ‘E’ and pass necessary orders on the said Representation and issue fresh Offer of Appointment to the Petitioner to the post of ‘Junior Station Attendant’ as prayed for in the said Representation within a reasonable time; b) ISSUE any other Writ or Order or Direction to meet the ends of justice in the facts and circumstances of the case. 2. Heard the learned counsel Sri. Ravi S. Balikai appearing for the petitioner and the learned counsel Sri. B.S. Kamate representing the respondents. 3. A selection process is initiated by the respondent KPTCL and in terms of the select list, the petitioner is selected on 08.03.2016. A communication is sent to the petitioner on 21.03.2016 to report to duties at Doddaballapur in terms of the offer of appointment on 19.03.2016. The petitioner contends that he received the letter of appointment which directed him to report on 21.03.2016, two days later on 23.03.2016. Therefore, - 4 - HC-KAR NC: 2025:KHC-D:16866 WP No. 103772 of 2017 the petitioner made all out efforts to reach Doddaballapur from Gokak and took almost one year to reach the place. On 10.03.2017 goes and submits a representation saying that he is still interested in the appointment that he was offered one year ago, therefore, he should be appointed. The respondents have not considered the same and the representation to that effect is still pending. The petitioner is therefore seeking a direction by issuance of writ in the nature of mandamus to consider his case for appointment as he was selected. 4. The petitioner as observed herein above, which is documented is that on 10.03.2017, he seeks to get back the appointment that he had lost on 21.03.2016. 5. The learned counsel submits he had to travel from Gokka to Doddaballapur. Therefore, he took one year for him to submit a representation. The submission does not merit any acceptance. 6. Therefore, the petitioner not only has lost seniority but has lost appointment also on a sheer disinterest in reporting to the place at the relevant point in time. - 5 - HC-KAR NC: 2025:KHC-D:16866 WP No. 103772 of 2017 7.
