Learned AGA accepts notice for the respondents.
1. The petitioner has approached this court seeking a writ of mandamus directing respondent No.4 to consider his representation dated 05.12.2025 and 16.12.2025, in respect of a tender process initiated by Panchayathraj Engineering Division, Vijayanagara District.

2. It is the case of the petitioner that pursuant to the direction of the State Government, respondent No.4 issued a tender notification on 23.10.2025 for execution of

works relating to construction of connecting roads under the Panchayath Raj Engineering Division, Vijayanagara. The petitioner participated in the tender process by submitting his application along with the requisite documents. According to the petitioner upon opening of the technical bid, his bid came to be rejected. Aggrieved by the same, the petitioner submitted representation dated 05.12.2025 and 16.12.2025, requesting respondent No.4 to consider his case before finalisation of the technical bid.

Learned counsel for the petitioner contended that non-consideration of the representations submitted prior to finalisation of the technical bid is arbitrary and violative of principles of fairness in tender matters. It is urged that the petitioner’s grievance deserved
consideration before proceeding further with the tender process.
4. Per contra, learned AGA appearing for the respondent-State submitted that the representations submitted by the petitioner would be considered before

finalisation of the technical bid and that the Line of Credit furnished by the petitioner was within the prescribed period and would be examined in accordance with law.
5. Having regard to the submission made by the
learned counsel for the petitioner and the statement made by the learned AGA on behalf of the respondent-State, this Court is of the considered view that the grievance of the petitioner can be appropriately addressed by directing respondent No. 4 to consider the representation submitted by the petitioner within a reasonable time.
6. This Court consciously refrains from expressing any opinion on merits or demerits of the petitioner's claim and rival contentions, leaving the same open to be considered by the competent authority in accordance with law.

ORDER i. The writ petition is disposed of.
ii. Respondent No.4 is directed to consider the representation of the petitioner dated 05.12.2025 and 16.12.2025 (Annexures-D and D1) and pass appropriate order in accordance with law before finalisation of the technical bid within a period of one week from the date of receipt of the copy of this order.
