ORDER: The present Writ Petition came to be filed under Article 226 of the Constitution of India seeking the following relief:-
“…to issue an appropriate Writ or order or direction more particularly writ of Mandamus, declaring the actions of the second and third respondents in interfering with construction of building of the petitioner in his patta land i.e., the house site measuring 221.76 square yards in Sy.No.112/2 of Akkarampalle village accounts bearing D.No.22-7-13, Ward No.22, Block No.7, Subba Reddy Nagar, Tirupati City, Chittoor District as illegal, null and void and consequently direct the second and third respondents not to interfere with the construction by the petitioner in accordance with building plan vide permission issued by the third respondent in B.A.No.1012/0287/B/TIR/SN/2016 dated 17.11.2016 and to pass…”

Today when the matter came up for hearing, Sri A.S.C.Bose, learned Standing Counsel appearing for the respondent No.2 has furnished a copy of instructions dated 07.01.2025 issued by the Deputy City Planner, Municipal Corporation, Tirupati, wherein it is stated that after the field inspection, the proposed building permission was granted to the petitioner vide B.A.No.1012/0287/B/TIR/SN/2016 dated 17.11.2016. It is further stated that at present the petitioner has constructed two temporary constructions of 10 X 10 Sq.feet asbestos sheet rooms having cement bricks walls without plastering and 20 X 33 Sq.feet room built with iron sheets and currently the petitioner is running “Venu Meat Foods Restaurant” in the said premises.
3. By recording the aforesaid instructions, this Court is of the opinion that the cause in the writ petition does not survive for further adjudication.
4. Accordingly, the Writ Petition is dismissed as infructuous. There shall be no order as to costs. Miscellaneous petitions pending, if any, in this Writ Petition shall stand closed. ___________________ JUSTICE V.SUJATHA Date: 08.01.2025 SRT
