4. The petitioner was implicated for the offences punishable under Sections 498-A, 494, 323 of the IPC read with 34 of the IPC. In connection with this, he was arrested and remanded to judicial custody in the year 2001. Consequently, the 3rd respondent has placed the petitioner under suspension with effect from 28.08.2001. Challenging the suspension, the petitioner has approached the Hon’ble Andhra Pradesh Administrative Tribunal by way of filing O.A.No.6677 of 2004.
Where under, the suspended the proceedings dated 31.08.2001, the petitioner was placed under suspension. Pursuant to the order, the petitioner was reinstated into service. 5. The petitioner was promoted as Assistant Engineer in the year 2006. However, he contends that he was entitled to be promoted to the post of Assistant Engineer in connection with proceedings dated 8/15.11.2002 with effect from 15.11.2002. Though he was concluded the criminal proceedings, this case of the petitioner was not considered for promotion with effect from
15.11.2002. The petitioner has made a representation dated 25.02.2007 to the 2nd respondent to promote him as Assistant Engineer with retrospective effect from 15.11.2002 on par with his juniors. However, the said representation was pending for consideration. 6. In the meanwhile, the seniority list of Assistant Engineers was issued vide circular dated 09.08.2017. Where under, the petitioner’s name was shown at Sl.No.192 and also at Sl.No.226. 3
7. The grievance of the petitioner is that his name was correctly placed at Sl.No.192 and the same shall be retained seeking deletion of his name at Sl.No.226, the instant writ petition is filed. 8. The 2nd respondent filed counter affidavit stating that the criminal proceedings initiated against the petitioner was ended in acquittal, the request of the petitioner to consider his case for appointment by transfer with effect from 2002 (@ Sl.No.192) would be considered in the next DPC for the next panel year. 9. Recording the said submissions, the Writ Petition is disposed of. There shall be no order as to costs.
