V.V SATISH (SC FOR APEPDCL) The Court made the following ORDER: The writ petition is filed seeking writ of mandamus, praying the following main relief:- “……declaring the impugned Memo No. SE/0/TPT/P0/AdmpAO-II/S4/D.No.110/2015 dated: 10-02-2015 of the 2nd Respondent retiring the Petitioner on 31-08-2016 on superannuation at the age of 58 years as illegal, Arbitrary contrary to Act 4 of 2104 to the extent of amending Section 3 of the A.P. Public Employment (Regulation of age of Superannuation) 1984 dated 27-062014 and the order in SLP (C) No. 14699 - 14702 of 2017 dated 05-052017 consequently set-aside the impugned Memo No. SE/0/TPT/P0/Adm/JA0-II/S4/D.No.110/2015 dated: 10- 02-2015 of the 2nd Respondent to the extent of retiring the Petitioner at the age of 58 years with a direction to the Respondents 2 to 4 to reinstate the Petitioner into service and allow to continue till the Petitioner completes 60 years of age with all consequential benefits and to pass……” 2. At the time of considering the matter, Sri K. Koutilya, learned counsel learned counsel appearing for the petitioner submits that consequent to the interim direction dated 09.06.2017 granted by this Court, petitioner services were extended upto the superannuation age of 60 years and subsequently he retired from service in the respondents Corporation. Making the said submission, learned counsel submits that cause in the writ petition does not survive for adjudication. 3. Considering the submissions made by the learned counsel for the petitioner, the writ petition is closed as no further orders are required in the lis. 4. However, this order will not preclude the petitioner from taking recourse to law as permissible, if so advised. There shall be no order as to costs.
