Mr. Sarthak Mehta, Advocate, for respondent No. 1. The instant application for release of 50% of the awarded amount has been filed on behalf of applicants- appellants. The appeal preferred by the applicants- appellants has been allowed in terms of judgment dated 08.04.2024, whereby, the compensation amount awarded by the Tribunal below has been enhanced from 11,30,000/- to ₹ 16,62,000/-. ₹ On the last date of hearing learned counsel representing the respondent No. 1 had sought time to seek instructions. It has been stated by the learned counsel today that he does not have any objection in case the amount lying deposited in the Registry of this Court is ordered to be released in favour of the applicants. As per the award passed by Tribunal below, both the applicants have been held entitled to the amount in equal shares, therefore, the present application is allowed and the amount lying deposited in the Registry of this Court is ordered to released in favour of the applicants in equal shares, and the same may be remitted in their Bank accounts, details whereof have been furnished and annexed with the application as Annexure A-1 & A-2, along with up to date interest against proper receipt and identification.
