1. The present contempt petition has been filed against willful violation of the order dated 04.03.2025 passed by this court in WPS No.8345 of 2024 whereby an interim order was passed directing the respondent authorities not to take any coercive steps against the petitioner till the next date of hearing.

Learned counsel for the petitioner would submit that the petitioner informed his ailment to the Block Education Officer, Ramanujnagar on 17.01.2025 and the petitioner was replaced from the post of Block Resources Co-ordinator vide order dated 11.12.2024 which was challenged in WPS No.8345 of 2024 in which the said interim order was passed, however, from the month of January, 2025 the salary of
2 the petitioner has been withheld by the respondents which is the willful violation of order dated 04.03.2025.
3. I have heard the counsel for the petitioner and perused the material annexed with the petition.

From perusal of material annexed with the writ petition, it transpires that the petitioner has challenged the order dated 11.12.2024 in the writ petition whereby he was repatriated to his original place of posting i.e. Govt. Higher Secondary School Krishnapur, Block Ramanujnagar by withdrawing the charge of Block Resource Co-ordinator in which the petitioner was protected vide order dated 04.03.2024 directing the respondents not to take any coercive steps against the petitioner. The petitioner was on medical leave from 16.12.2024 to 20.02.2025 and thereafter he joined his duty. Non payment of his salary from January, 2025 would be subject matter of the said writ petition which is pending
consideration before this court in which the petitioner has challenged the order dated 11.12.2024. Therefore, in the opinion of this court there may be other reasons for non payment of salary, but the same does not come under the purview of any willful violation of the order dated
04.03.2025.
5. Accordingly, this court is not inclined to issue notice to the respondents in the present contempt petition and the same is hereby dismissed. The petitioner is at liberty to avail his remedy in an appropriate proceeding of the said writ petition. Sd/- (Ravindra Kumar Agrawal) Judge inder
