The Court made the following:
COMMON ORDER: As the parties and issue involved in both the Revision Cases are one and the same, both the Revision Cases are disposed of with a common order.
2. Criminal Revision Case No.1743 of 2016 was filed by the petitioner/husband challenging the order passed in Crl. Appeal No.201 of 2015 on the file of the learned VII Additional District Judge, West Godavari at Eluru which was preferred by the petitioner herein.

3. Criminal Revision Case No.1896 of 2016 was also preferred by the petitioner/husband against the Crl. Appeal No.190 of 2015 passed by the learned VII Additional District Judge, West Godavari at Eluru which was preferred by the respondent No.2.
4. Heard learned counsel for the revision petitioners and learned Assistant Public Prosecutor.
5. The Inspector of Police, Women Police Station, Eluru, submitted a report along with notice served on respondent No.2 and the statement of respondent No.2 and the order passed by the learned VII Additional District Judge-cum-Family Court, West Godavari at Eluru in H.M.O.P.No.24 of 2019 dated 23.10.2019 dissolving the marriage in between the petitioners therein, under Section 13-B of the Hindu Marriage Act on the ground of mutual consent.
6. In both the Criminal Appeals, the petitioner suffered an adverse
order. Notice of respondent No.2 is not yet returned. However police have recorded the statements of respondent No.2 in which she stated that a mutual consent divorce petition was filed in H.M.O.P.No.24 of 2019 and the learned VII Additional District Judge-cum-Family Court, West Godavari at Eluru dissolved the marriage in between the petitioner and respondent No.2. Respondent No.2 submitted that she do not want any further action against her estranged husband/petitioner.
7. The Criminal Appeal No.201 of 2015 was dismissed by the learned VII Additional District Judge, West Godavari at Eluru by observing that the appellant there in was not entitled for any relief. The Criminal Appeal No.190 of 2015 was allowed in part by the learned VII Additional District Judge, West Godavari at Eluru by granting a separate residence for an amount of Rs.2,000/- towards rent and Rs.10,000/- towards damages, in default of payment, the petitioner has to undergo simple imprisonment for two months.
8. In view of the fact that a mutual consent divorce petition was allowed and the marriage between the petitioner and respondent No.2

has been dissolved by the competent Court having jurisdiction, nothing remains in these two Revision Cases for any further adjudication. They have to be disposed of as settled out of Court and cause of action does not survive.
9. For the above reasons, both the Criminal Revision Cases are
disposed of as settled out of Court. No order as to costs. As a sequel, miscellaneous petitions pending, if any, shall stand closed.
