08.07.2025 Court No. 35 Item No.258 Rakib W.P.A. 20446 of 2024 Gaurav Paul. VS The State of West Bengal & Ors. Mr. Dhananjay Banerjee, Mr. Md. Shamimuddin, Mr. Sk. Samiul Haque. ... for the Petitioner. Mr. Tulsi Das Roy. ...for the State. Petitioner is aggrieved by the fact that out of the sum of Rs.18.45 lakhs which has been cheated an amount of Rs.8.94 lakhs were frozen in different accounts of ICICI Bank, Axis Bank, Canara Bank, Equitas Bank and Yes Bank. This is reflected in the order dated 17.10.2023 passed by the learned A.C.J.M., Alipore in connection with ACGR 956/23. The said order was passed on 17.10.2023 and further informations are not available before this Court. Considering that the learned A.C.J.M. has directed for release of the said amount in favour of the petitioner namely, Gaurav Paul and his account is maintained with HDFC Bank which is referred to in the order dated 17.10.2023, I direct that the learned A.C.J.M. Alipore would direct the Bank authorities to transmit such amount and to that effect would be at liberty to issue harsher process of law until and unless the concerned bank satisfies the learned Court/A.C.J.M. Alipore that there are other directions for not releasing the amount. 2 Learned advocate appearing for the State is present and submits that since the State has not challenged the order and has accepted the order passed by the learned A.C.J.M. Alipore in connection with ACGR- 956/2023 it is only left to the bank authorities to release the aforesaid amount, in case there are no predicaments pointed out by the said bank. With the aforesaid observations WPA 20446 of 2024 is disposed of. All concerned parties shall act on the server copy of this order duly downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities. (Tirthankar Ghosh, J.)
