This appeal is directed against order dated 18.03.2025 passed by the Additional District Judge, Court No. 9, Kanpur Nagar whereby, when the matter came up before the Court for decision on Issue No. 3 as preliminary issue, it was observed that it would be appropriate to decide the same after evidence is recorded and matter was fixed for evidence. Subsequent thereto, the election petition itself has been decided on 11.09.2025 against which First Appeal No. 790 of 2025 is pending consideration before this Court. 2. In view of the fact that the election petition itself has been decided and the order impugned is of interlocutory nature, besides the fact that the appeal is not maintainable, the fact that the issue, as raised in the appeal, has also been raised in the appeal arising out of the final order, reserving liberty to the appellant to raise the issue in the pending appeal, the present appeal stands disposed of.
