Despite of service of notice, none entered appearance on behalf of respondents. 03. In O.S.No.267 of 2022, a money decree was passed on 18.08.2003 and the Judgment Debtor (J.Dr) did not discharge the debt amount. The Decree Holder (D.Hr) filed E.P.No.74 of 2009 on the file of Principal Junior Civil Judge, Piler seeking arrest and detention of the Judgment Debtor (J.Dr) in civil prison for realization of the decree amount and the same was allowed. Aggrieved by the order dated 28.07.2014 in E.P.No.74/2009, this revision petition is filed. 04. On 26.09.2014, this Court passed the following Order: “… On condition that the petitioner deposits the E.P. amount in two equal installments, the first within four weeks from today and the second within four weeks thereafter, there shall be stay of his arrest. In case of default in payment of either of the two installments, the interim order shall stand automatically vacated”. 05. Sri Avula Pedda Mallaiah, is the revision petitioner. This revision petition was filed in the year 2014, by that time as per the 3 cause title he was ninety (90) years old. The very earnest submission of the learned counsel for the petitioner is that, despite of their best efforts, they are unable to gain contact with the revision petitioner. 06. Considering the above facts, this present revision petition is dismissed for non-prosecution. Both parties are entitled to explore their rights in duly instituted proceedings if and when so they desire. The dismissal of this revision has not bearing on the rights and duties of the parties.
