1. Sri Girish Chandra Sharma, learned Advocate holding brief of Sri Rajrshi Gupta, learned counsel for applicant and Sri Pradeep Kumar, learned AGA for the State are present.
2. The present anticipatory bail application has been filed on behalf of the applicant in F.I.R./Case Crime No. 196 of 2020, under Sections 147, 148, 149, 353, 307 IPC and Section 7 Criminal Law Amendment Act, Police Station Auraiya, District Auraiya with a prayer to enlarge him on anticipatory bail during trial.
3. Considering the fact that instant anticipatory bail application is pending since the year 2021 on 08.09.2025 a report was called from the court concerned whether cause of action still survives or not. Pursuant to the order passed by this Court, the court concerned submitted its report, which is on record and from its perusal it reflects, on 04.04.2024 CJM concerned committed the case to the court of sessions by noting that applicant is on bail, therefore, it appears, applicant has already been released on bail.
4. At this stage, learned counsel appearing on behalf of applicant also submits, even as per his information, applicant has been enlarged on regular bail.
5. Therefore, considering the facts and circumstances of the case, it appears, the instant anticipatory bail application has become infructuous and accordingly the same stands dismissed as infructuous.
