The applicant has preferred this application under Section 482 of Bhartiya Nagarik Suraksha Sanhita, 2023, for grant of Anticipatory Bail, apprehending his arrest in connection with Crime No.294/2025, registered at Police Station – Urga, District VAISHALI LUCKY NAGARIA Digitally signed by VAISHALI LUCKY NAGARIA Date: 2025.08.13 11:02:44 +0530
2 – Korba (C.G.) for the alleged commission of offence punishable under Sections 296, 115(2), 331(2), 3(5), of BNS, 2023.

As per prosecution story, in brief, is that the police station Urga, District- Korba registered a case number 294 of 2025 against the accused Manoj Kumar, Kanwar under sections 296, 115(2), 331(2), 3(5) of BNS. The applicants have forcefully entered the house of the applicant Pratap Singh Kanwar on 05.07.2025 at 11:00 p.m. and using obscene and filthy language and assaulting the applicant and his wife, mother and son with hands, fists and sticks.

Learned counsel for the applicant submits that the applicant has been falsely implicated in this case. He submits that applicant neither involved in the commission of crime nor tried to commit any offence. It has been argued by learned counsel for the applicants that applicants assaulted injured persons because they were raised objection for playing DJ, as a result a quarrel took place between the applicants and injured persons and injured persons were received grievous injury on their body parts Therefore, he prays for grant of anticipatory bail to the present applicants.
4. On the other hand, learned State counsel opposes the anticipatory bail application of the present applicants and submits that on the date of incident when injured persons alongwith other villagers raised objection for playing DJ on a high volume then a quarrel took place, as a result injured
3 persons sustain several grievous injuries on their body parts therefore, they are not entitled for grant of anticipatory bail.
5. I have heard learned counsel for the parties and perused the case diary.

Considering the nature and gravity of the offence, and also taking into account the fact that on the date of incident when injured persons alongwith other villagers raised objection for playing DJ on a high volume then a quarrel took place, as a result injured persons sustain several grievous injuries on their body parts. Accordingly, I am not inclined to grant anticipatory bail to the applicants.

Accordingly, the anticipatory bail application of the applicants– Manoj Kumar, Revatiraman, Yashvant Kumar Kanwar filed under Section 482 of Bhartiya Nagarik Suraksha Sanhita, 2023 involved Crime No.294/2025, registered at Police Station – Urga, District – Korba (C.G.) for the alleged commission of offence punishable under Sections 296, 115(2), 331(2), 3(5), of BNS, 2023 is rejected.
