A case has been registered against the petitioner and Others for the offence under section 20(b)(ii)(B) read with 8(c) of the Narcotic Drugs and Psychotropic Substances Act. 3. The case of the prosecution is that: on 28,9.2024 at about ll.00 am, on receipt Of Credible information regarding illegal possession and transportation Of ganja, Sol of police, Kothavalasa Police Station, along with staff reached opposite to RTC complex, Kothavalasa Village and noticed two persons With a suit case. on seeing the police, they tried to escape. Then the POliCe apprehended them who are Al and A2, and on enquiry, they disclosed their identity particulars and police seized 9.700 kgs of ganja from them and they confessed that they purchased the ganja from petitioner/A3, police apprehended petitioner/A3 on 07.ll.2024 and got remanded him to judicial custody. 4. Learned Assistani public Prosecutor submits that major part of the investigation is completed and charge sheet filed and it was numbered as N.S.C.No.71 of 2024. 6. A perusal of the material aval'lable on record goes to showthat the petl'tioner/A3 was arrested and remanded to judicial custody on o7.ll.2024. Basing on the confessional statement of co-accused, the Petitioner has been shown as an accused in the present crime. The accusation is against the co-accused only. Except the confessional statement, there is no other materl'al to connect the petitioner wI'th the crl'me. pursuant to the confessional statement of co-accused, nothI-ng has been seized from the petitioner. 7. ln vI'eW Of the aforesaI-d facts and Circumstances Of the case, this court is inclined to grant baI'I to the petl-tioner herein, on the following conditions. (i) The petitI'Oner/A3 herein shall be released on his executing a Personal bond for Rs.10,000/-(Rupees ten thousand only) with two sureties for a like sum each to the satisfaction of the learned I Additional Sessions Judge, Vizianagaram; (ii) On release, the petitioner shall appear before the station House Officer concerned once in a week l'.e. on every sunday between 10.00 a,m. and o5.00 p.m., till further orders. 8.
