JUSTICE SANJAY KUMAR DWIVEDI --- For the Petitioner :- Mr. Rahul Kumar, Advocate For the State :- Mr. Gautam Rakesh, Advocate ---- 02/12.11.2025 Heard learned counsel appearing for the petitioner as well as the learned counsel appearing for the State. 2. The petitioner is apprehending his arrest in connection with Kuru P.S. Case No.37 of 2024 corresponding to G.R. No.50/2025, for the alleged offences registered under Sections 419, 420 and 34 of Indian Penal Code pending in the Court of learned Judicial Magistrate 1st Class, Lohardaga. 3. Learned counsel appearing for the petitioner submits that the petitioner is a government teacher working at +2 Gaya High School, Gaya and was working at his school on examination duty at the relevant time. He further submits that the agreement is there between the informant and co-accused Kashifur Rahman with regard to coal supply. He then submits that the amount has also been paid to the Kashifur Rehman. He next submits that the only allegation is made against the petitioner that the petitioner has purchased the stamp for the agreement. He also submits that the petitioner has got no criminal antecedent as 2025:JHHC:33822 --2-- A.B.A. No. 6397 of 2025 disclosed in paragraph No.13 of the petition. He submits that the petitioner has also complied Section 41A of Cr.P.C. He next submits that in identical situation co-accused persons have already been granted anticipatory bail in A.B.A. No.8123 of 2024 and 5177 of 2025. 4. Learned counsel appearing for the State opposes the prayer and submits that the allegations are there against the petitioner. 5. Considering that the agreement is between Kashifur Rehman and the informant and the amount has also been taken by Kashifur Rehman and in identical situation co-accused persons have already been granted anticipatory bail in aforesaid A.B.As. and the petitioner has got no criminal antecedent as disclosed in paragraph No.13 of the petition, I am inclined to provide anticipatory bail to the petitioner. 6. Accordingly, the petitioner, above named, is hereby directed to surrender before the learned Court within three weeks from today, and in the event of his surrender/arrest, the petitioner, above named, shall be released on bail, on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand), with two sureties of the like amount each, to the satisfaction of learned Judicial Magistrate 1st Class, Lohardaga in connection with Kuru P.S. Case No.37 of 2024 corresponding to G.R. No.50/2025, subject to the conditions as laid down under Section 482(2) of Bharatiya Nagarik Suraksha Sanhita, 2023. (Sanjay Kumar Dwivedi, J.)
