This petition has been filed by the petitioner seeking for the following relief(s):- ABHIGYA SAXENA Digitally signed by ABHIGYA SAXENA 2 “10.1 The Hon'ble court may be pleased to issue a writ of Mandamus commanding respondent nos. 1 and 3 to issue appointment letters in the favour of petitioner. 10.2 The Hon'ble court may be pleased to issue a writ of Mandamus c ommanding respondent nos. 1 and 3 to give seniority and other benefits to the petitioner from the date of orders of which the appointment letters were issued in the favour of other selected candidates from the same selected list.” 2. In response to the petition, the Respondent-State has filed a return. Pertinent excerpts from Paragraphs 5 and 6 of the said return are reproduced hereinbelow: - “5. It is respectfully submitted by the answering respondents that, as per the advertisement dated 26.10.202, 13 posts were endorsed in the Scheduled Tribe criteria from 7 department, wherein 1 post was lying vacant from the department of District Planning and Statistics even after thorough postings of the other selected candidates, with regard to the same the petitioner filed a representation and the same was forwarded to the Commissioner, Bastar Division Jagdalpur on 11.11.2022 concerning the aforesaid post lying vacant. Copy of which is already annexed as Annexure P/5. 3 6. It is respectfully submitted that, on 16.08.2022 notice was issued by the Office of Collector (District Planning & Statistics), District- North Bastar Kanker [CG] with regard to the appointment of the petitioner on the post of Assistant Grade III, through Junior Employee Selection Board, Bastar Division, Jagdalpur [CG].” 3. In view of the submissions made in the return filed by the Respondent-State, particularly as noted in paragraphs 5 and 6, it is evident that the Respondent authorities have acknowledged the Petitioner’s grievance. Consequently, the Respondents are directed to consider the case of the Petitioner strictly in accordance with law and to take appropriate action expeditiously. 4.
