The petitioners are apprehending their arrest in connection with Khaga PS Case No.16 of 2024 (G.R. Case No.264 of 2024), for offence registered under section 414 and 34 of the IPC, Section 11(1)(d) of Prevention from Cruelty to Animals Act, 1960 and Section 12 and 13 of the Jharkhand Bovine Animals (Prohibition of Slaughter) Act, 2005, pending in court of learned Judicial Magistrate, First Class, Madhupur (Deoghar).

Learned counsel for petitioner submits that petitioner happened to be the owner of vehicle in question which was met with an accident and it has been further alleged that in said vehicle bovine animals were being carried. He then submits that petitioner was not present on the spot and vehicle in question was being driven by the driver. He also submits that petitioner has got no criminal antecedent as disclosed in paragraph no.13 of the petition. He then submits that four accused persons have been granted anticipatory bail in ABA No.3993 of 2024.
4. Learned State counsel opposes prayer and submits that illegally the bovine animals were being carried in the said vehicle.

Considering that the petitioner is owner of the said vehicle and was not present on the spot and said vehicle was being driven by the driver of the vehicle and in identical situation, four of the accused persons have been granted anticipatory bail as aforesaid and further the petitioner has got no criminal antecedent as above, I am inclined to grant anticipatory bail to petitioners.

Accordingly, petitioners, above named, are hereby directed to surrender before learned court within three weeks from today, and in event of their surrender/arrest, petitioners, above named, shall be released on bail, on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand) each, with two sureties of like amount each, to satisfaction of learned Judicial Magistrate, First Class, Madhupur (Deoghar), in connection with Khaga PS Case No.16 of 2024 (G.R. Case No.264 of 2024), subject to the conditions as laid down under section 482(2) of Bhartiya Nagrik Suraksha Sanhita (BNSS), 2023.
