The present MCC has been filed seeking recalling of order dated 16.07.2025 passed in WPS No.7364 of 2025 and to restore WPS No.7364 of 2025 to its original number. Learned counsel for the petitioner would submit that the petitioner-Hermon Ekka filed two separate writ petitions being WPS No.7364 of 2025 and 7375 of 2025 for separate 2 cause of action. In both these writ petitions since the petitioner was one and same, when WPS No.7364 of 2025 came up for hearing on 16.07.2025, by mistake and on the pretext that issue involved in both the writ petitions are same, he withdrew WPS No.7364 of 2025. This mistake was realized by him at the time of hearing WPS No.7375 of 2025 on 30.07.2025 and therefore he has filed present MCC for recalling of the order dated 16.07.2025 and to restore WPS No.7364 of 2025 as according to him he had withdrawn WPS No.7364 of 2025 by mistake and wants to pursue the said writ petition on merits. The counsel for the State raised formal objection. Considering the submissions made by the counsel for the petitioner and also considering the issue involved, the MCC stands allowed, order dated 16.07.2025 is recalled and WPS No.7364 of 2025 is restored to its original number.
