1. On 21.08.2026, the following order was passed:
“1. Nobody appeared on 06.08.2026. Even though intermittently some advocates appeared and the matter was adjourned from time to time, Mr. H.V. Thakur points me out Clause 10 of the management agreement entered into between the parties on 03.05.2025, wherein the methodology of appointment of the arbitrator is carved out. However, since nobody appeared for the respondent, strictly by way of a last chance, the matter is placed on
28.08.2026.
2. It is made clear that if there is no appearance on behalf of the respondent, the matter would proceed further.
3. Stand over 28.08.2026.”
2. Today also, nobody appears for the non-applicant.
3. I have heard Mr. H. V. Thakur, learned counsel for the applicant. He draws my attention to the arbitration clause involved in the management agreement and, more particularly, Clause 10 thereof, as per which the parties have resolved to refer the dispute to arbitration. He also points me out the communication of the applicant/association dated 01.09.2025, proposing the name of Hon’ble Shri B. P. Dharmadhikari, Retd. Chief Justice of this Court, as an arbitrator. 4. Even though a reply is filed, nobody appears for the non- applicant today also.
5. In that view of the matter, Hon’ble Shri B. P. Dharmadhikari, Retd. Chief Justice of this Court, is appointed as an arbitrator to resolve the dispute between the parties.
6. Process fee of Rs. 15,000/- (Fifteen Thousand Rupees) be deposited within three weeks from today.
7. Application is allowed and disposed of as such.
