In view of the submissions made by learned counsel for the applicant-appellant and for the reasons mentioned in the application, the application for condonation of delay is allowed and the delay of 117 days which occurred in filing the restoration application, is condoned. 5. The restoration application has been filed by the applicant- appellant for restoration of Civil Misc. Appeal No.4048/2019 to its original number, which was dismissed in default by the Coordinate Bench of this Court vide order dated 16.05.2023. 6. Considered the submissions. 7. Having regard to the submissions made by counsel for the applicant-appellant and for the reasons mentioned in the restoration application, this Court deems it just and proper to allow this restoration application and restore the appeal to its original number. 8. Accordingly, the present restoration application is allowed subject to payment of cost of Rs.500/- to be deposited with the Rajasthan High Court Munshi Sangh, Jaipur Bench, Jaipur. 10. On submitting the receipt of deposited amount by the counsel for the applicant/appellant with the Registry, the Civil Misc. Appeal No.4048/2019 be restored to its original number.
