GP FOR WOMEN DEV CHILD WELFARE(AP) The Court made the following: 2 THE HONOURABLE DR JUSTICE VENKATA JYOTHIRMAI PRATAPA WRIT PETITION NO: 32578 of 2018 ORDER: This Writ Petition is filed under Article 226 of Constitution of India with the following prayer for: “…to issue a writ order or direction more particularly one in the nature of Writ of Mandamus proceedings in letter No 13/2018 dated 12.06.2018 issued by the 4th respondent where under promoting the private respondent as Anganwadi Worker ignoring the claim of the writ petitioner and to declare the same as illegal, arbitrary and in gross violation of rights guaranteed under Articles 14, 16 and 21 of the Constitution of India and pass…” 2. Heard Ms. B.Geeta, learned Counsel for the petitioner and learned Assistant Government Pleader for Women and Child Welfare for the respondents. 3. Learned Counsel for the petitioner would submit that though the petitioner is a Senior to the respondent No.5, she was promoted as Anganwadi Worker bypassing the Seniority. 4. Learned Assistant Government Pleader would submit that since the Anganwadi Center is earmarked for ‘SC/ST’ habitations, in pursuance of the G.O.Ms.No. 39 dated 06.09.2011 only ‘SC/ST’ candidates should be selected as Anganwadi Workers. In that view, the petitioner who is a ‘BC’ candidate and the respondent No.5 being a candidate from ‘Scheduled Caste’ Community, the candidate was selected as such. 5. In the light of the submissions made and on perusal of the material on record, though the petitioner is Senior to the respondent No.5 as Anganwadi 3 Helper, she could not become Anganwadi Worker in the Center which was earmarked for SC/ST habitations. In that view, the respondent No.5 being an SC person, is rightly promoted as Anganwadi Worker. 6. In the light of aforementioned premises, this Court does not find force in the contentions of the petitioner. Accordingly, the Writ Petition is dismissed. No order as to Costs.
