Perused the record. 3. O.S.No.470 of 2015 on the file of II Additional Junior Civil Judge, Guntur prays to declare the title and grant recovery of possession of immovable properties. 4. The plaint is premised that the defendant encroached a part of the property that belongs to the plaintiff. Whether any extent of property is encroached or not is matter for evidence. However to ascertain how much extent was encroached is a fact to be determined. It has always been the law that the extent of encroachment if any can never be established or determined through oral evidence and it all requires somebody’s presence to measure it. Perhaps, having in mind, the plaintiff moved a petition Under Order XXVI Rule 9 and Section 151 of CPC. After due hearing, the trial Court dismissed it stating that, the plaintiff/petitioner intended to take measurements of properties that belong to 3'^'^ parties were sought to be measured. 3 05. The reasons mentioned by the Court below are to assailed in this revision. However, such dismissal of the petition would still leave the trial Court keep guessing as to what exactly is the encroached portion if any.
