This application is filed by the complainant challenging the judgment dated 19.05.2023 passed in appeal before the learned Sessions Court, Malkapur, in Appeal No.08 of 2023, thereby reducing the sentence of six months to three months. The application is for condonation of delay of 41 days in filing the appeal. Though the notice was issued by this Court on 26.02.2025, however, the non- applicant is avoiding the service on one or the other ground. This Court taken note of conduct of the non-applicant has issued non-bailable warrant vide order dated 31.07.2026. The office note shows that the warrant is also not executed. 3. Thus, taking into consideration the reasons stated in the application, the application is allowed.
