Heard. 2. The petitioner/ applicant preferred the instant CRMP for modification of the order dated 09-07-2025 passed in the earlier CRMP No.1932 of 2022 filed by the petitioner for quashment of the FIR lodged against him, on the ground that some wrong fact stated by the counsel for the petitioner has been recorded in the order i.e. “the petitioner has already been granted bail by the competent authority”, which has been mentioned in the order dated 09/07/2025, thought the petitioner is not on regular/ anticipatory bail by any Court of law. 3. Mr. Rajesh Kumar Sharma, learned counsel for the petitioner/ applicant would submit that the aforesaid averment has been made by his associate who appeared on behalf of the petitioner on his instructions, as he was not well on the date of hearing. The averment was made due to some miscommunication, before the Court and accordingly the Court has observed in its order that ‘the petitioner has already been granted bail by the competent authority’. He further tenders apology for the said inadvertent mistake and miscommunication and prays that the said part may be deleted from the order dated 09/07/2025 passed by this Court. 4. On due consideration and looking to the submissions advanced by the learned counsel for the petitioner, it is found that the error has been occurred on the part of the petitioner himself inadvertently, hence after looking to the entire fact situation of the case, para 3 of the order dated 09-07-2025 passed in CRMP No. 1932 of 2022 is modified to the extent hereinbelow :- 3 / 3 “3. Learned counsel for the petitioner submits that the matter has already been amicably settled between the parties outside the Court.” Remaining contents of the order dated 9-7-2025 passed in CRMP No.1932 of 2022 shall remain unaltered. 5. As the matter has already been settled between the parties, the Investigating Officer concerned, who after verifying the settlement arrived at between the parties, is directed to submit a police report under Section 173(2) of the CrPC (Now Section 193(3) of the BNSS) before the Magistrate concerned expeditiously, in accordance with law, if already not submitted, preferably within a period of four weeks from today, till then no coercive steps shall be taken against the petitioner. 6. With the aforesaid modifications, the instant CRMP stands disposed of. 7. Copy of this order be placed in the record of CRMP No. 1932 of 2022 and further it be read along with the order dated 09/07/2025 passed in the said petition.
