ORDER: The present Writ Petition came to be filed under Article 226 of the Constitution of India seeking the following relief:-
“…to issue an appropriate writ of mandamus directing the respondents particularly 3 and 4 respondents to demolish the unauthorized construction constructed in Plot No. 48 in Survey No.310/ lA and 311/3A at Nethanagar, Nellore to an extent of 12 Ankanas i.e. 96 Sq. yards (in total extent of 48 Ankanas) by 5th respondent herein without any permission or authority forthwith and to direct the 3rd respondent to take immediate action on Lay- complaint dated 02- 09-2013…”
2. Heard learned counsel for the petitioners and learned Government Pleader for Municipal Administration and Urban Development, learned Government Pleader for Revenue and Sri. M. Venkata Ramana,
learned counsel for the 5th respondent.
3. Today when the writ petition came up for hearing, learned Standing Counsel has produced a copy of the Lok Adalat Award No.647 of 2017, dated 09.09.2017 of the Lok Adalath Bench, Nellore wherein the petitioners and the 5th respondent have settled the matter with certain terms and conditions. Hence submitted that the cause in the writ petition would not survive any more.
4. In view of the fact that the petitioners and the 5th respondent herein have settled the issue before the Lok Adalat Bench, Nellore vide award dated 09.09.2017, this Court is of the opinion that no further orders would be necessary in the present writ petition and that the matter has become infructuous.
5. Accordingly, this writ petition is dismissed as infructuous. There shall be no order as to costs.
