1. This is second bail application of the applicant. The first bail application of the applicant has been dismissed on merits vide order dated 05-05- 2025 passed in MCRC No.3055 of 2025.
2. The applicant is an accused in offence of Crime No.513/2025 registered at P.S. Sarkanda, District Bilaspur for the offence punishable under Section 6 and 7 of C.G. Gambling (Prohibition) Act, 2022 and he is in jail since 06-04-2025. Digitally signed by MOHAMMAD AADIL KHAN

Learned counsel for the applicant would submit that the seizure witnesses in the case have been examined as PW-2 and PW-3 and they have not supported the prosecution’s case, there are 17 witnesses cited by the prosecution, but only thee witnesses have been examined till date, therefore, there is every possibility of delay in conclusion of trial. The applicant is in jail since 06-04-2025. The other co-accused persons have been released on bail by the learned trial Court. Therefore, the applicant may be released on bail.
4. On the other hand, learned counsel for the State opposes.

Considering the submissions made by learned counsel for the parties, considering the nature of allegation and the material collected during the investigation, further considering that the first bail application of the applicant has been dismissed on merits vide order dated 05-05-2025 and thereafter, three witnesses have been examined and the trial is in advanced stage, I am not inclined to release the applicant on bail considering it to be change in circumstances.
