1.
Heard the parties.
2.
It is the grievance of the petitioner that since there is no order from the Court so far as this petitioner is concerned, the Merger Scale has not been granted to him.
3.
It is his grievance that the other similarly situated persons have been granted the Merger Scale. He also refers to the
order passed in LPA No.22 of 2018 in the case of “State of Jharkhand Anr. Vs. Prashant Kumar Mishra & Ors. which has been affirmed by the Hon’ble Supreme Court in the case of “The State of Jharkhand Anr. Vs. Prashant Kumar Mishra & Ors., in Special Leave to Appeal (C) No(s).11104 of 2020 dated
18.09.2020.
4.
Considering the said submission, I am of the opinion that the State has to take a decision in terms of the aforesaid judgments to grant the Merger Scale to the petitioner. Once the

Merger Scale has been granted to the similarly situated employees/readers of the University, then the petitioner should also get all the same benefits.
5.
Thus, I direct the respondents to pass an appropriate
order in the matter of the petitioner, considering the judgment passed in LPA No.22 of 2018 and by the Hon’ble Supreme Court in the case of “The State of Jharkhand Anr. Vs. Prashant Kumar Mishra & Ors., in Special Leave to Appeal (C) No(s).11104 of 2020 dated 18.09.2020” and the other orders passed by this Court. The fact that the petitioner has not approached this Court should not come in his way to get the benefit of the scale.
6.
With the aforesaid observation, this writ petition stands
disposed of.
