ORDER:
Learned counsel for the petitioner submitted that the petitioner is arraigned as Accused No. 5 in SC (POCSO) No. 169 of 2022 on the file of the learned I Additional Sessions Judge, Kurnool. Learned counsel further stated that the petitioner is the maternal uncle of the accused and is charged only under Section 506 of the IPC. The police, after investigation, have filed a charge sheet alleging offences under Sections 328, 376, 506 read with 34 of the IPC and Sections 3 & 4 of the POCSO Act. It was submitted that even according to the complaint, no specific allegation is made against the petitioner. Initially, a criminal petition was filed by the mother of LW-4. It was also submitted that the petitioner is a practicing advocate and is facing trial in a case in which he is not personally involved. He was allegedly unaware of the relationship between the 1®' accused and LW-4. Apart from being the maternal uncle, he had no role in committing the offences charged. Therefore, he sought quashing of the case against him. On the other hand, learned counsel for the 2'^'^ respondent
2. St submitted that the petitioner is charged under Section 506. The 1 accused faces allegations under Sections 328, 376 read with 34 of the IPC and Sections 3, 4, 13 and 14 of the POCSO Act. The
4 HN,J Crl.P.No.9823 of 2022 other accused (A.2 to A.4) are charged under Section 506 read with 34 of the IPC. The police investigation reportedly found that Accused Nos. 2 to 5 threatened LW-4, stating that she should take the blame to support A-1, otherwise they would kill her and her entire family. These allegations are specifically mentioned in the charge sheet. Learned counsel urged that these are triable issues which must be examined in court following a full trial.
3. Heard learned counsel for the petitioner, learned Assistant Public Prosecutor appearing for the 1®* respondent-State. and
learned counsel for the 2""' respondent.
4. After considering the submissions, this Court observes that the allegations against the petitioner merit examination at trial. This Court cannot resolve such triable issues at this stage and therefore cannot quash the proceedings. Without addressing the merits, this Criminal Petition is disposed off, with liberty granted to the petitioner to raise ail relevant grounds when the trial Court takes up the matter. Pending miscellaneous petitions, if any, shall stand closed.
