ANTICIPATORY BAIL APPLICATION U/S 482 BNSS No. - 2631 of 2025 Applicant :- Amit Kumar And 2 Others Opposite Party :- State of U.P. Counsel for Applicant :- Gaurang Dwivedi Counsel for Opposite Party :- G.A. Hon'ble Vivek Varma,J.
1. Sri A.K.S. Bais, Advocate has filed his vakalatnama on behalf of the informant, the same is taken on record. 2. Heard learned counsel for the applicants as well as Sri V.P. Tripathi, learned A.G.A. for the State and Sri A.K.S. Bais, counsel for the informant. 3. The present application has been filed with the prayer to grant anticipatory bail to the applicants in Case Crime No.481 of 2024, under sections 333, 191(3), 131, 109(1), 115(2) and 351(3) B.N.S., P.S. Kotwali Dehat, District Saharanpur. 4. Counsel for the applicants submits that the applicants have been falsely implicated in the present case. The applicants have no criminal antecedents. The investigation is pending. The applicants have apprehension of their arrest in the above mentioned case. 5. On the other hand, learned AGA for the State and counsel for the informant have opposed the prayer for bail. 6. Having heard learned counsel for the parties and having perused the record this court prima facie finds that the applicants were armed with a sharp edged weapon (Balkati), co-accused Shakti Singh with a pistol, Pawan and Nishant armed with Lathi Danda assaulted the informant and his brother Mohit Rana. As per medical report, the informant received injuries, which were found simple in nature, whereas Mohit Rana received four incised wound. Injury nos. 1,2 and 3 on the skull region were referred for X-ray/ C.T. examination. As per the report of C.T. head cranial fracture with soft tissue hematoma was found. The injuries were found grievous in nature and were on vital part of the body. The medical report of the injured was supported by the prosecution version. In view of the injuries sustained by the injured Mohit Rana it cannot be said that the applicants have been falsely
implicated. 7. In my opinion, this is not an appropriate case for grant of anticipatory bail.
Hence the application is hereby rejected leaving it open to the applicants to apply for regular bail before the trial court, which application when filed, may be considered on its own merits, without being prejudiced by any observation made in this
order.
