Ramganj, Ajmer, for the offence under Sections 406, 420 and 120-B of IPC.

[2025:RJ-JP:40262] (2 of 3) [CRLMB-12010/2025] applicant undertakes not to repeat offence and cooperate with investigation/trial, which will take time.
3.
Learned counsel for the petitioner submits that petitioner is a female and the offence is triable by Magistrate. He further submits that the main allegation is upon husband of present petitioner. He also referred the investigation and submitted that no recovery is effected from present petitioner and presently she is in custody since 08.09.2025.
4. Learned Public Prosecutor has vehemently opposed the bail application and submitted that the allegations are grave and serious in nature.
5. Heard learned counsel for the petitioner-accused and learned Public Prosecutor. Perused the material placed on record by both the parties.
6. On the basis of complaint dated 17.05.2024 lodged by Vikas Pepawat and six other persons about cheating and breach of trust by Devendra Kalot, railway employee and his wife Soniya Kalot LIC agent resulting in lost of ₹ 40,00,000/- (forty Lakh) to them a criminal case is registered and matter is investigated. During investigation both husband and wife were arrested on 08.09.2025 and finally a charge-sheet is drawn against them.
7. No doubt about the fact that petitioner is a female and the offence is triable by Magistrate First Class and there is no criminal antecedents against the present petitioner. There are seven complainants and the police investigation suggests that after registration of FIR present petitioner and her husband were untraceable as they have left Ajmer after
[2025:RJ-JP:40262] (3 of 3) [CRLMB-12010/2025] selling their house. The investigation further suggests that no recovery is effected by the investigating officer and the evidence suggests involvement of Devendra and his wife Soniya.
8. The facts and the material indicate that the alleged offence are of serious nature and role attributed to applicant is prima facie sufficient to consider complicity of applicant in the crime. Therefore, at this juncture, considering the evidence collected so far, this is not a fit case to enlarge the applicant accused on bail.
9. Considering the gravity of allegations and overall facts and circumstances of the case, it is appropriate to dismiss the bail application of the applicant accused at this stage.
10. Accordingly, the application for bail filed under Section 483 of BNSS preferred by Soniya Kalot W/o Devendra Kalot, is hereby dismissed.
