The applicant has preferred this First Bail Application under Section 483 of B.N.S.S. for grant of regular bail, as he has been arrested in connection with Crime No. 373/2025, registered at Police Station Seepat, District – Bilaspur (C.G) for the offence punishable under Section 34(1)(d)(p) & 34(2) of the C.G. 2. The brief facts of the prosecution case are that on 04.07.2025, pursuant to secret information received from an informant, the police conducted a search of the applicant and seized 155 liter of handmade kachchi mahua sharab from his possession

Learned counsel for the applicant submits that the applicant has been falsely implicated in this case. It is respectfully submitted that the manner, the applicant has not committed any crime & the alleged liquor has not been recovered from the conscious possession of the applicant he is in jail since 05.07.2025 and the conclusion of the trial is likely to take quite long time. Therefore, he prays for releasing the applicant on regular bail.

On the other hand, learned State Counsel appearing for the State/non-applicant opposes the bail application and submits that in the present case charge-sheet has been filed before the competent Court. She further submits that seized Total quantity 155 bulk liter country made liquor from the possession of the applicant. As such, he is not entitled for grant of bail.
5. I have heard learned counsel for the parties and perused the case diary.

Considering the facts and circumstances of the case, the nature and gravity of the offence alleged against the applicant, and the fact that 155 bulk liters of country-made liquor have been seized from the possession of the applicant, which is a huge quantity, without any valid license, and no plausible explanation has been
3 offered in this regard, furthermore, considering the gravity and seriousness of this case, and it being unlikely to be a case of false implication, this Court is of the view that it is not a fit case to enlarge the applicants on bail.
7. Accordingly, the bail application of the applicant namely, Sanjay Kumar Loniya, involved in Crime No. 373/2025, registered at Police Station Seepat, District – Bilaspur (C.G) for the offence punishable under Section 34(1)(d)(p) & 34(2) of the C.G. Excise Act, is rejected. Sd/- (Ramesh Sinha)
