Petitioner apprehends arrest in a case registered for the offence punishable under sections 30, 30 (a) , 38 ( i ) ( ii ), 36 and 41 of Bihar Prohibition and Excise Act. 3 . As per the prosecution case , informant disclosed that he got information that some persons are bringing liquor on a tractor trailor and a Maruti car is also ahead of the tractor trailor. Both the vehicles were intercepted but the person who was sitting on the front seat of Maruti car managed to flee away . The driver of the Maruti car and the driver of the tractor
Patna High Court CR. MISC. No.28359 of 2025(2) dt.15-07-2025 2/3 were apprehended who disclosed their names as Kunal Kumar singh and sonu Kumar. From the Maruti car about 60 litres of liquor was recovered and from the tractor trailor about 2862.720 litres was recovered. 4. Learned counsel for the petitioner submits that petitioner is neither owner nor driver of the seized vehicles. The name of petitioner transpired on the confessional statement of other co-accused persons who were apprehended on the spot. No incriminating article has been recovered from conscious possession of this petitioner and he has got no concern with the alleged occurrence . Petitioner has got no criminal antecedent of similar nature . 5 . Learned counsel for the State opposes the bail petition of the petitioner. 6.
Considering the aforesaid facts and circumstances of the case, in the event of arrest or surrender within eight weeks from today, let the petitioner, as named above, be enlarged on bail on furnishing bail bond of Rs.10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of the learned 2nd Exclusive special Excise Judge Saran in connection with Manjhi P.S. case No. 31 of 2020, subject to the conditions laid down under section 438(2)
