Counsel for the appellant has referred to the office order dated 10.11.2025 Annexure (A-I), whereby the appellant has further been posted in Karsog Section which is in pursuance of the order dated 30.10.2025 (Annexure P-3), whereby the appellant had been transferred to Sundernagar from Nerchowk under Elect. Division Mandi, Himachal Pradesh.
2. Apparently, the said document dated 10.11.2025 (Annexure A-1) which has now been placed on record was issued after the learned Single Judge dismissed the writ petition 1 Whether reporters of Local Papers may be allowed to see the judgment?
2 on 04.11.2025 for the reasons given therein that there was only distance of about 20 K.Ms. between Nerchowk and Sundernagar.
3. Counsel for the appellant has submitted that the fact of the works at Karsog Section had also been mentioned in paragraph Nos. 5 and 6 of the petition, but the effective implementation order was only passed after the decision of the writ petition.
4. In such circumstances, we are of the considered opinion that in view of the subsequent developments, it is always open to the appellant to bring this fact to the notice of the learned Single Judge by taking out of appropriate proceedings.
5. Accordingly, counsel for the appellant submits that he does not wish to press the present appeal with liberty to challenge the impugned order afresh after the decision of the review petition. Resultantly, the present appeal stands dismissed as withdrawn.
