1. The petitioners pray for de-freezing the savings bank account with the Bank of Baroda.
2. The learned advocate representing the bank submits that, an instruction has been received from the CEN PS SOUTH DIVISION BENGALURU CITY on 2nd August, 2024 for marking lien in respect of the sum of Rs. 2,25,000/- standing in the name of the petitioner no. 1.
3. The bank account of the petitioner has been marked centrally by the Bank’s Fraud Risk Management Department on the basis of the cyber complaints received at NCRP Portal. An FIR has also been lodged. The investigation over the cyber crime is in progress.
4. Learned advocate representing the police relies upon a report by the Inspector-in-Charge, Bagnan Police Station signed on 14th August, 2024 which mentions about the lien marked under the Bank’s Fraud Risk Management Department to the tune of
2 Rs. 2,25,000/- maintained in the subject savings account of the petitioner no. 1.
5. As it appears that, the investigation over the cyber crime is continuing, accordingly, it will not be proper to direct the bank to defreeze the bank account, at this stage.
6. It will be open for the petitioners to approach the forum where the criminal proceeding is pending for further relief.
7. The writ petition stands disposed of.
8. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance of all the requisite formalities.
