ORDER: The instant Criminal Petition under Section 482 of the Code of Criminal Procedure, 1973^ has been filed, by the Petitioner/A.2, seeking quashment of the Proceedings against him in Crime No. 148 of 2020 on the file of Mahanandi Police Station, Kurnool District, registered for the offences punishable under Sections 120-B, 420, 409, 506, 203, 464 and 509 read with 34 IPC.
2. Heard Sri Challa Ajay Kumar, learned counsel for the Petitioner, and Ms.K.Priyanka Lakshmi, learned Assistant Public Prosecutor appearing I for respondent /State. Perused the material on record. For short ‘the Code’

Learned counsel for the Petitioner would submit that on the Complaint given by the Complainant, the present crime has been registered against A.l to A.6, who are employees of Sri Mahanandiswara Swamy Temple. Petitioner herein is A.2 and he is devotee of Mahanandiswara Swamy and he did not commit any offence as lodged against him. He never misused the temple assets. Further, due to personal conflicts between the Complainant and Petitioner/A.2, the present false and fabricated case has been lodged. Learned counsel would submit that except bald and omnibus allegations, no specific overt acts are attributed against them.
4. Learned counsel would further submit that the presence of the Petitioner may be dispensing with before the Trial Court and the Criminal Petition may be disposed of by giving liberty to the Petitioner to raise such
contentions before the Trial Court in defence.
5. Considering the
submissions made, the Criminal Petition is
disposed of and the Petitioner/A.2 is at liberty to raise the present
contentions before the Trial Court in his defence. However, the presence of the Petitioner/A.2 before the Trial Court is dispensed with, except on the specific dates as directed by the Trial Court. Pending applications, if any, shall stand closed.
