GP FOR SCHOOL EDUCATION (AP) The Court made the following: 2 THE HONOURABLE DR JUSTICE VENKATA JYOTHIRMAI PRATAPA WRIT PETITION NO: 32583 of 2018 ORDER: This Writ Petition is filed under Article 226 of Constitution of India with the following prayer for: “…to issue a Writ or Order or Direction more particularly one in the nature of Writ of Mandamus declaring the action of the third and fourth respondents in not approving the selections made on 10.09.2017 by the petitioner school on the basis of the approval orders of the third respondent issued in proceedings No.1745/84/2017 dated 05.06.2017 as illegal, arbitrary, discriminatory and against the rules issued in G.O.Ms.No.1 Education (PS-2) Department dated 01.01.1994 and consequentially direct the third and fourth respondents to approve the selections made on 10.09.2017 for the aided vacancies as per the proposals submitted by the petition in letter No.2/2017 dated 10.09.2017 to the fourth respondent and pass…” 2. None represented on behalf of the petitioner. 3. The relief claimed in the present petition is a direction may be given to the respondents to take a decision on the proposal submitted by the petitioner to the respondent No.4. The record shows the interim direction has been given directing the respondents to take a decision on the proposal submitted by the petitioner to the respondent No.4 vide orders dated 29.10.2018 in I.A.No. 01 of 2018. 4. Learned Assistant Government Pleader for School Education would submit that they have passed order in obedience to the interim order, the RJD of School Education, Guntur has approved to fill up the vacancies vide orders dated 06.07.2019. Learned Assistant Government Pleader would further submit that in the light of the same, the relief has become infructuous. 3 5. It is beneficial to extract the copy of the written instructions placed on record: “ I submit that the Regional Joint Director of School Education, Guntur has approved to fill up in the school as per RTE, Act, 2009 as below vide Progs.ESE02-11021/35/2019 B SEC-RJD-GNT dated 06.07.2019.
