[2025:RJ-JP:46889] HIGH COURT OF JUDICATURE FOR RAJASTHAN BENCH AT JAIPUR S.B. Criminal Miscellaneous Bail Application No. 14285/2025 Mukesh S/o Phool Chand, Aged About 28 Years, R/o Banskheri Lodan, Police Station Bhalta, District Jhalawar (Raj.) (At Present Confined In District Jail Jhalawar). ----Petitioner Versus State Of Rajasthan, Through PP ----Respondent For Petitioner(s) : Mr. Shailesh Kumar Panwar For Respondent(s) : Mr. Amit Gupta, PP HON’BLE MR. JUSTICE VINOD KUMAR BHARWANI Order 20/11/2025 The instant bail application has been filed under Section 483 B.N.S.S. on behalf of accused-petitioner in the matter arising out of F.I.R. No.244/2025 registered at Police Station Bhalta District Jhalawar for the offence(s) punishable under Section(s) 137(2), 87, 115(2), 64(2)(M) B.N.S. & Section 5L/6 of POCSO Act. Learned counsel for the petitioner submits that the petitioner has been falsely implicated in the case, he has nothing to do with the alleged offence and he is behind the bars since 15.08.2025. Learned counsel further submits that in the complainant’s statement recorded under Section 183 BNSS, no allegation has been made against the petitioner. After investigation, charge- sheet has been filed in the matter. Trial of the case is likely to take a long time to conclude, till then, his further incarceration would not serve any fruitful purpose and he is ready and willing to [2025:RJ-JP:46889] (2 of 2) [CRLMB-14285/2025] furnish his bail bonds. Therefore, the bail application deserves to be allowed. Learned Public Prosecutor has vehemently opposed the bail application. No one is appeared on behalf of the complainant/victim despite information about filing of this bail application. Heard learned counsel for the parties and perused the material available on record. Taking into consideration the submissions put forth and overall facts & circumstances of the case but without commenting upon detailed merits of the case, this Court deems it fit to enlarge the accused-petitioner on bail. Therefore, the bail application is allowed. Accused-petitioner namely Mukesh S/o Phool Chand shall be released on bail, if he is not required in any other case, provided he furnishes a personal bond in the sum of Rs.50,000/- (Fifty Thousand) together with two sureties in the sum of Rs.25,000/- (Twenty-five Thousand) each to the satisfaction of the learned trial court with the stipulation that he shall appear before that Court and any other court to which the matter is transferred, on all subsequent dates of hearing and as and when he is called upon to do so.
