1. The present contempt petition has been filed for initiation of the proceeding for contempt for non-compliance of the order dated 27.08.2025 passed by this Court in W.P. (C) No.4598 of 2025.
2. The operative portion of the order dated 27.08.2025 reads as under:-
“4. It is settled principle of law that the Circle Officer is a service provider and not an adjudicator. If there is no dispute, he is supposed to provide the service on payment of fee. If any dispute is raised, then he is not supposed to enter into the dispute as it will be beyond his jurisdiction and it may amount to trespass also.
5. The law regarding demarcation of land has been settled by the Division Bench of this Court vide order dated 14.11.2024, passed in L.P.A. No.399 of 2023.
6. In that view of the matter, the present writ petition is, hereby, disposed of directing the Circle Officer, Namkum to proceed in accordance with law and with a caution that he can go for demarcation only and only if there is no dispute with regard to the said land. If there is any dispute, he is not supposed to demarcate the land.
7. With the above observation and direction, the present writ petition is hereby disposed of”
3. In view of above direction, it is clear that the demarcating authority is only a service provider not an adjudicator and as such no contempt lies.
