The present C482 Petition has been filed by the petitioner challenging the Judgment and Order dated 25.01.2017, passed by the learned District & Sessions Judge, Haridwar. By the said order dated 25.1.2017, learned Secessions Judge has set aside the order dated 23.11.2016, passed by the Judicial Magistrate/Ist Additional Civil Judge (J/D), Haridwar. 2. There is no representation for the petitioner. On the previous date also, none appeared for the petitioner. 3. Mr. Pradeep Kumar Chauhan, learned counsel for the respondent submits that the C-482 Petition is liable to be dismissed, as the petitioner has filed a Civil Suit No. 23 of 2010 for similar cause of action, which was dismissed. Thereafter, the Civil Appeal No. 56 of 2022 was also dismissed by the learned 3rd Additional District Judge, Haridwar. 4. Counsel for the respondents further 2025:UHC:7753 submits that the petitioner has died, as would be evident from the order dated 5th April, 2024 passed in Civil Appeal No. 47 of 2022. 5.
