This second appeal has been admitted for hearing by this Court on 09.05.2023. 2. All the appellants and respondents are present in person present before this Court today for settling their dispute. 3. During pendency of the second appeal, the appellants and the respondents who are family members, have decided to amicably settle inter se dispute between them. Accordingly, they have jointly filed a compromise application under Order 23 Rule 3 of the C.P.C. supported by affidavit of the parties. They have settled their dispute in view of clause B of prayer of the compromise application, which reads as under:- “B. As per the settlement deed, the khasra no. 102 area 4.62 acre/1.870 hectare and khasra no. 25/1 area 1.38 acre/0.558 hectare out of total area 2.525 hectare will be decree in the share of respondents no. 1 to 6 and the rest of suit land bearing khasra no. 23, 24, 49 and 57 area measuring 0.340 hectare, 0.368, 0.028 and 0.085 hectare and rest of area 1.967 hectare of khasra no. 25/1 situated at village Rivapara Patwari Halka no. 8 Tahsil and District Mungeli shall be decreed as title holder and possessor in favour of respondent no. 7.” 4. The judgment and decree passed by the First Appellate Court are modified in terms of compromise arrived at between the parties mentioned at clause B of prayer of the compromise application filed under Order 23 Rule 3 of the C.P.C. 3 5. Accordingly, the instant second appeal stands disposed of. 6. The settlement arrived at between the parties as mentioned at clause B of prayer of the compromise application will be part and partial of the award and decree. 7. A decree be drawn up accordingly.
