1. Heard Mr. Ankit Singhal, learned counsel for the petitioner. Also heard Mr. Trivikram Nayak and Mr. R. K. Kesharwani, learned counsel appearing for their respective respondents.
2. The present petition has been filed by the petitioner with the following prayer :-
“10.1 That, this Hon'ble Court may kindly be pleased to pass any appropriate writ, order or direction to quash and set aside the rejection of the Petitioner's bid in Tender No. CSIDC/EE/DIV.-1/2025-26/05 and system tender No. 170079, in the interest of justice; 10.2 That, this Hon'ble Court may kindly be pleased to pass any appropriate writ, order or direction to declare that the Petitioner is eligible to participate in
3 the aforesaid tender and consequently direct the Respondent No. 1 and 2 to open the Petitioner's price bid, in the interest of justice; 10.3 That, this Hon'ble Court may kindly be pleased to pass any appropriate writ, order or direction to set aside the financial bid evaluation dated 18.7.2025 done by the Respondent No. 1 and 2 in the interest of justice; 10.4 In alternative, That, this Hon'ble Court may kindly be pleased to pass any appropriate writ, order or direction to Respondent No. 1 and 2 to disclose the reason for rejection of the Petitioner's bid and provide a copy of the bid evaluation record, in the interest of justice; 10.5 Any other relief or relief(s) which this Hon'ble Court may deem fit and proper in view of the facts and circumstances of the case, may also kindly be granted.”

At the very outset, learned counsel for the petitioner would submit that the bid of the petitioner has been rejected by the authority concerned without assigning any reason, however, yesterday the authority has supplied the rejection order by disclosing the reason, hence he seeks permission of this Court to withdraw the present petition with liberty to challenge the rejection order passed by the authority concerned.

Learned counsel for the respondents have no objection.

5. In view of the submission made by learned counsel for the petitioner, the present petition is dismissed as withdrawn with the aforesaid liberty, as prayed for.
